Restrictions for Licensees in Response to COVID-19 Outbreak
Effective Monday, March 16, 2020 at 8:00PM until Further Notice
Pursuant to the Governor’s order, effective Monday, March 16, 2020 at 8:00PM, all licensed on-premises establishments (e.g. restaurants, bars, taverns, clubs, arenas, catering establishments, etc.) must cease on-premises sales of alcoholic beverages and/or food. Additionally, all licensed manufacturers with on-premises privileges must also cease on-premises sales of alcoholic beverages and/or food; however, a licensed manufacturer may continue all manufacturing operations. This restriction shall continue until April 15, 2020 but may be extended or reduced depending upon the circumstances.

NYS has put out Guidance for Large Gatherings and Public Spaces
Effective March 13, 2020 at 5:00PM, organizers hosting large gatherings must postpone or cancel any events with in-person attendance of more than 500 participants.
Effective March 13, 2020 at 5:00PM, private and public operators of establishments or organizers of events with fewer than 500 occupants or attendees must operate at no more than 50% of their maximum occupancy.

New York State Announces Mandatory Closures & Guidance for Cleaning Retail Establishments
Effective TODAY (Monday, March 16) at 8 PM, Governor Cuomo announced the mandatory closure of all gyms, movie theaters, casinos, and bars and restaurants (except delivery or take-out) until further notice. Additionally, all non-essential businesses or services are encouraged to close at 8 PM. This is not mandatory; however, highly recommended. Essential businesses include grocers, gas stations, pharmacies, and health facilities. The Governor also announced the closure of all schools, effective Wednesday, March 18. NFIB will continue to make every effort to share relevant information with members.
The New York State Department of Health (DOH) continues to provide interim guidance for businesses and employers. For retail stores, DOH has provided Guidance for Cleaning and Disinfecting for COVID-19.

NFIB Legal Center: How Small Business Can Prepare for Coronavirus
NFIB’s Legal Center has also made useful information for small business owners available on its website. All employers in New York, regardless of size, should prepare for the impacts of COVID-19 in the workplace. In addition to considering how current events might affect their leave policies, employers also need to consider the impact of federal and state employment laws, such as the Americans With Disabilities Act, the Family and Medical Leave Act, the Occupational Safety and Health Act, and the New York Disability Benefits law and the Paid Family Leave Benefits law (PFL).
